Welcome to InsightMood. By downloading, installing, or using the InsightMood application (the "App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.

1. Service Description

InsightMood is a personal emotion tracking application that provides AI-assisted analysis to help you understand your emotional patterns. The App allows you to log your emotions, view trends over time, and receive AI-generated insights.

AI Output Disclaimer: The AI-generated analysis, insights, predictions, and recommendations provided by InsightMood may be inaccurate, incomplete, or misleading. AI outputs are produced by automated systems and should not be relied upon as the sole basis for any decision. Always use your own judgement when interpreting AI-generated content.

Important Medical Disclaimer: InsightMood is not a medical device. The AI analysis provided does not constitute psychological counselling, medical diagnosis, or treatment advice. The App is intended for personal self-reflection only. If you are experiencing a mental health crisis or have concerns about your mental health, please contact a qualified healthcare professional or your local emergency services immediately.

2. No Professional Advice

Nothing in the App — including AI-generated insights, emotional analysis, weekly reports, predictive insights, and any other content — constitutes medical, psychological, psychiatric, legal, financial, or any other form of professional advice. The App is designed solely as a personal self-reflection tool. You should not act or refrain from acting based on information provided by the App without first seeking independent professional advice appropriate to your situation.

3. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent that you meet this age requirement.

4. Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information when creating your account. The App enforces a single-device login policy; signing in on a new device will sign you out of any previously active session.

5. Subscriptions

5.1 Free and Premium Plans

InsightMood offers a free tier with basic features and a Premium subscription with additional capabilities including advanced AI analysis styles, extended insights, and more.

5.2 Billing

Premium subscriptions are billed through Apple's App Store on a monthly or annual basis.
Payment will be charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription rate.
You can manage or cancel your subscription in your Apple ID account settings.

5.3 Refunds

Refund requests are handled by Apple in accordance with the Apple Media Services Terms and Conditions. We do not process refunds directly.

6. User Conduct and User Content

You agree not to:

Use the AI analysis feature to process content that is unlawful, harmful, threatening, abusive, or otherwise objectionable.
Attempt to reverse-engineer, decompile, or disassemble the App.
Use automated tools (bots, scrapers) to access the App's services.
Circumvent rate limits, authentication, or other security measures.
Use the App for any purpose that violates applicable laws or regulations.

You are solely responsible for all content you submit to the App, including emotion entries, notes, and any text processed by AI features. You represent and warrant that your content does not infringe the intellectual property rights or other rights of any third party, and does not contain unlawful, defamatory, or otherwise harmful material.

7. Intellectual Property

The App, including its design, code, features, and branding, is owned by InsightMood and is protected by applicable intellectual property laws.
You retain ownership of all content you create within the App, including your emotion journal entries and notes.
By using the AI analysis feature, you grant us a limited, non-exclusive license to process your submitted content solely for the purpose of providing the analysis service.

8. Account Deletion

You may delete your account at any time from within the App (Settings > Delete Account). Upon deletion:

All your server-side data will be permanently and immediately deleted.
Your Firebase authentication account will be removed.
This action is irreversible.

Important: Deleting your InsightMood account does not automatically cancel your Apple subscription. You must cancel your subscription separately in your Apple ID account settings (Settings > Apple ID > Subscriptions) to avoid continued billing.

9. Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in activity that is harmful to other users or our services. We will make reasonable efforts to notify you before taking such action, except where immediate action is required to protect the service or comply with legal obligations.

10. Service Availability and Changes

We strive to keep InsightMood available and reliable, but we do not guarantee uninterrupted access. We reserve the right to:

Modify, suspend, or discontinue any part of the App (including features, content, or pricing) at any time, with or without notice.
Perform scheduled or unscheduled maintenance that may temporarily affect availability.
Discontinue the App entirely, in which case we will make reasonable efforts to provide advance notice.

We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App or any part thereof.

11. Indemnification

You agree to indemnify, defend, and hold harmless InsightMood, its officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with:

Your use of or access to the App;
Your violation of these Terms;
Your violation of any third-party rights, including intellectual property rights;
Any content you submit to the App.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

The App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
We do not warrant the accuracy, reliability, or completeness of any AI-generated content.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.
Our total aggregate liability for any claim arising from your use of the App shall not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim.

13. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

14. Changes to These Terms

We may modify these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App. Your continued use of the App after such changes constitutes acceptance of the updated Terms.

15. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure outages, pandemics, or third-party service disruptions.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and InsightMood regarding your use of the App, and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the Province of Alberta, Canada.
